1. Subject of the Terms
These Terms govern the relationship between Pixels – obrt za izradu internet stranica, Ulica Bože Gumpca 51/a, Croatia (hereinafter: Provider), and any client ordering the creation of a website or using the Made4Booking platform (hereinafter: User).
The subject of these Terms is the provision of the following services:
– creation of websites for private accommodation owners on the Made4Booking platform; and
– use of the Made4Booking platform.
These Terms ensure that the User, before concluding a distance contract, is clearly informed about all circumstances relevant to the conclusion, execution, and termination of the contract, in accordance with applicable legislation.
2. General Conditions
The service is available at www.made4booking.com. All parts of the service, including design, templates, and platform functionality, constitute the Provider’s copyrighted work. No published data, documents, or information may be reproduced, distributed, or used for commercial purposes without the Provider’s explicit written consent.
The User may be any legal entity or adult individual who accepts these Terms during payment, registration, or use of the service. The Provider reserves the right to decline any service request if deemed justified.
Purchase conditions form part of the distance contract. Prior to confirming an order, the User will be required to acknowledge these Terms, and after the contract is concluded, the Terms will be delivered to the User via email. The Provider may modify the Terms at any time, with changes taking effect upon publication on the service’s website.
Although the Provider continuously tests and improves the service, it cannot guarantee error-free operation or uninterrupted availability. In case of malfunction, the Provider will take reasonable steps to resolve the issue promptly.
The Provider shall not be liable for any direct or indirect damages or losses arising from the inability to use the platform, downtime, errors, incompatibility with the User’s systems, or any other operational issues, including loss of profit, clients, market position, data, opportunities, or reputation.
The Made4Booking application is provided on an “as is” basis without any warranties regarding potential defects. The Provider will use reasonable efforts to maintain functionality but does not guarantee error-free performance.
The Provider is not responsible for damages caused by loss or destruction of data, unauthorized access, alteration, disclosure, or misuse-especially if caused by force majeure, equipment failure, incorrect handling, viruses, or interference from third-party software.
The User is solely responsible for the copyright compliance of any content published on their website, particularly photographs. The User must ensure they hold the necessary rights for publication. In case of disputes with rights holders, the User bears full responsibility.
3. Key Service Characteristics
Made4Booking Platform
Made4Booking is a website creation and management service provided as a hosted solution. The business model includes service packages that cover platform use, technical support, hosting, and regular updates necessary for proper operation.
The platform enables:
– professional presentation of accommodation units;
– responsive design suitable for all devices;
– clear display of pricing, availability calendars, galleries, things to do and features;
– simple inquiry forms;
– search and filtering options depending on the selected package.
Website Creation Service (Made4Booking)
Includes:
– entering all accommodation data, descriptions, features, and photos for supported languages (User provides translations or can be translated with Google Translate, Chat Gpt, Grok etc…);
– creating the homepage with key highlights;
– creating details pages with pricing and availability;
– creating a contact page;
– creating a things to do page
– domain configuration;
– basic technical SEO.
Platform Usage Service
Includes:
– hosting and server resources used to store website data;
– email support for platform usage;
– monitoring and maintaining security updates;
– a user account for editing prices and availability
4. Pricing
Prices displayed on the service website are listed in euros.
Pricing depends on the selected service package and may change over time. Payments are made via internet banking or bank slip. Bank transaction fees are not included in the service price.
5. Ordering Process
After reviewing the service details and pricing on the website, the User may request a non-binding offer by submitting their contact data and the number of accommodation units.
The User will receive an offer via email based on the provided information.
A contract is considered concluded when the User confirms acceptance of the offer by email or completes payment, after which the Provider confirms receipt.
The User must make the payment within the deadline stated in the offer.
6. Delivery Deadlines
After the contract is concluded, the Provider will request all necessary materials: accommodation details, descriptions, translations, photos, price lists, and availability information.
The Provider cannot start website creation before receiving all required materials.
Once the Provider confirms that the materials are complete, the delivery period begins.
The maximum delivery time is 15 days, while the average time is 5 days.
A website is considered delivered when the Provider notifies the User via email.
The User has 7 days from receipt of the delivery email to report any errors. After the 7-day period, all further modifications are done by Provider but with an extra service fee LINK NA PDF S CIJENAMA.
7. Contract Duration
The contract regarding website creation is fulfilled once the Provider delivers a functional website and the User pays the full service fee.
The contract regarding platform usage is concluded for a period of one year.
The Provider will send a renewal offer 15 days prior to expiration.
8. User Data and Privacy
Details regarding handling personal data are provided in the Privacy Policy published on the service website.
The User is the owner of all data stored within their Made4Booking account. The User is responsible for accuracy and completeness of submitted data.
The Provider is obligated to protect User data from accidental loss, destruction, unauthorized access, alteration, or misuse. However, the Provider is not liable for damages caused by force majeure, system failure, viruses, user mishandling, or external software.
By accepting these Terms, the User grants consent for the Provider to collect, process, and store personal data as required for service provision, in accordance with applicable laws. The Provider may disclose User data to government authorities upon lawful request and may transfer data to countries where hosting servers are located, provided adequate data protection exists.
Aggregated, anonymized data may be used by the Provider without limitation.
Data may be retained for up to two years after service termination unless the law requires longer retention.
Upon registration, the User receives login credentials and must protect them from unauthorized use. The User is responsible for all activities conducted under their account.
9. Interoperability of Digital Content
The website created on the Made4Booking platform is a copyrighted work of the Provider. It is provided to the User solely for use through the Made4Booking editing interface.
The website’s code cannot be transferred to another server or handed over to third parties for maintenance.
10. Final Provisions
Any disputes arising from the use of the Service shall fall under the jurisdiction of the court competent for the Provider’s registered business address.
The Provider may modify website content or platform functionality at any time without prior notice and is not responsible for any consequences arising from such changes.
The Provider may outsource parts of the service to third parties without requiring User consent, while remaining responsible for fulfillment toward the User.
Revised Terms apply to all existing and future Users.
